Recent Oklahoma Domestic Violence Case Breaks Stereotype

Oklahoma domestic violence rates are often startling. The state is continually making headlines for its high number of child abuse cases, and it ranks 7th in the nation for women murdered by men. According to a 2002 report by the Oklahoma State Department of Health, 91% of those seeking emergency medical treatment for injuries from intimate partner violence were women; only 9% of the injured victims requiring emergency services were men. However, as any law enforcement official or Oklahoma domestic violence lawyer can attest, not every domestic dispute fits the stereotype or matches the statistics. One recent domestic violence conviction in Oklahoma proves the exception. Oklahoma domestic violence lawyer On July 22, 2010, a 70-year-old Oklahoma woman pleaded guilty to beating her 73-year-old husband with a cane when she became convinced that he was having an affair. According to prosecutors, Gussie Mae Kelley “deliberately and maliciously” beat her husband, causing numerous contusions and lacerations requiring stitches. While Kelley’s conviction could result in up to ten years in prison, sentencing guidelines recommend that she serve 27-33 months. Because of the weak condition of the victim and the severity of the beating, the case was tried federally. While prosecutors alleged that Kelley had previously abused her husband, there is no record of her ever being reported, arrested, or charged with domestic violence. The typical victim of intimate partner violence in Oklahoma is a woman aged 25-34. Of the 2,538 people seeking emergency medical treatment for injuries caused by Oklahoma intimate partner violence in 2002, only 2 victims were males over the age of 65. Regardless of statistics and stereotypes, however, every case is unique and requires individual treatment by investigators, prosecutors, and defense attorneys in Oklahoma. Whenever two people are in a relationship, emotions can run high. While domestic violence is a serious issue, law enforcement agents and the courts must realize that not all allegations of abuse are true. Accusers may amplify or even completely invent incidents of abuse in an effort to gain attention or seek revenge. When someone is charged with domestic abuse or intimate partner violence in Oklahoma, it is imperative to contact an Oklahoma domestic violence attorney with a proven record of successful defense. Metrolink service reductions that took effect Monday left some commuters in Ventura County waiting and confused when they arrived for their regularly scheduled trains. Teresa Domingo and her husband, Raynaldo, regularly took the 11:05 train from Moorpark to Pomona, the closest stop to their home in Chino Hills. The two work as caretakers for the elderly in Camarillo on the weekend.

In the state of California if a person has a blood alcohol percentage or BAC over .08 percent then you could be charged for DUI. Vehicle Code sections 23152(a) and 23152(b) In section 23152(a) it states that it is illegal to for somebody who is under the influence of an intoxicating beverage or under the combined influence of an alcoholic beverage or drug to drive a vehicle. In section 23152(b) it states that it is unlawful for any person who has a .08 percent or more by weight to drive a vehicle. If charged with DUI, you can either be charged with a misdemeanor and a felony. A misdemeanor charge occurs when a person is charged with drunk driving and no personal injury or property damage happens. One-year jail time may occur. A felony charge is when injury occurs and several years of jail time could be served. Being in this type of position can be tough for anyone but knowing your rights is something that that can be very helpful. In any criminal case you always have the right to remain silent. The right to remain silent does not mean you don’t have to cooperate. You must still cooperate with the officer when they ask for your drivers license, insurance etc. You should not admit anything. Anything you say can be repeated back to the judge or jury if your case goes to trial. You should ask to speak to an attorney immediately. You also should submit to blood or alcohol tests if this is your first driving under the influence. But if your drivers license is already revoked you may have nothing to lose refusing to submit. Knowing your rights and selecting the right attorney for your DUI/DWI case is important. Being helpless is one of the worst feelings ever so being prepared if you are ever in this situation may save you time and money. Comments

The huge oil rig explosion off the coast of Louisiana is far much more severe than the Exxon Valdez spill in Alaska. This spill will most likely cause damage to residential, commercial and recreational facilities. The difference between this spill and the Exxon Valdez is that more states will suffer far more economic interests other than Alaska. Texas, Louisiana, Mississippi, Alabama and Florida will all be affected greatly. Many industries will be affected but the fishing industry will be hit the hardest. During the Exxon Valdez spill thousands of fishermen were put out of work, which put their families in financial hardship. It is important to preserve the rights of those affected by this disaster. History has been known to repeat itself and if we learned anything from hurricane Katrina we now know that relying on government agencies may not be the best way to approach the situation. Here are some facts about the Gulf oil spill: • The clean up process so far costs about $6 million dollars a day. • The coast guard estimates 210,000 gallons of are being dumped into the Gulf daily. • The total cost of clean up and paying out damages in lawsuits may cost the company up to $3 billion dollars at the end.
